1. General terms and conditions
Art. 1: Scope of application These general terms and conditions of sale and delivery apply to all sales contracts concluded via the www.juval.ch website (hereinafter: the website), and form an integral part of such contracts. These general terms and conditions take precedence over any general terms and conditions of business of the other party. These terms and conditions are subject to change. The general terms and conditions in force at the time the order is placed shall apply to the contract.
Art. 2 : Ordering and conclusion of contract Only persons of legal age may place orders via the website. After placing an order via the website, the buyer will receive an order confirmation by email, which corresponds to Juval Horlogerie Sàrl’s acceptance to conclude the contract. The sales contract binds the buyer to Juval Horlogerie Sàrl, Rue des Musées 26, 2300 La Chaux-de-Fonds (NE).
Art. 3: Prices Prices are quoted in Swiss francs (CHF), including VAT and excluding shipping costs. The prices displayed on the website on the day of the order are decisive for the contract. No reimbursement will be made in the event of a price change between the date of order and delivery. Juval Horlogerie Sàrl may modify its prices at any time and without notice.
Art. 4 : Delivery charges Delivery charges are payable by the purchaser. In the case of partial deliveries (art. 8), shipping costs will only be invoiced once. Orders are dispatched on Tuesdays, Wednesdays, Thursdays and Fridays only.
The purchaser is required to provide precise information when entering his contact details (street, number, e-mail address, postcode, town, country, necessary codes, telephone number). In the event of return of the parcel(s), Juval Horlogerie Sàrl may invoice the purchaser for the related costs. For shipping rates, please refer to the Shipping Conditions.
Art. 5 : Taxes and customs duties Orders placed via the website by purchasers domiciled outside Switzerland may be subject to taxes and customs duties, which are imposed upon arrival of the parcel at the addressee. These taxes and customs duties are the sole responsibility of the buyer. Prior to placing an order, the purchaser is advised to check with the competent authorities of the country in which he/she is domiciled.
Art. 6 : Payment Payment is made by credit/debit card and Paypal.
Art. 7 : Delivery Juval Horlogerie Sàrl endeavours to process orders as quickly as possible. However, delivery times are purely indicative and non-binding. Delays in delivery do not entitle the purchaser to withdraw from the contract, refuse the goods or claim compensation or damages. Indicative delivery times may be extended in the event of obstacles for which Juval Horlogerie Sàrl is not responsible, such as force majeure, official decisions, natural phenomena, war, operational or transport problems, strikes, accidents, illness, as well as delayed, defective or faulty deliveries.
Art. 8 : Unavailability and partial deliveries If one or more items ordered are unavailable, Juval Horlogerie Sàrl will inform the customer by email, who will be offered the following choice: partial delivery, i.e. dispatch of the available items and putting the unavailable product(s) on hold; modification of the order by cancelling the unavailable product(s); dispatch of the order only when all the products are available. Please note that the credit card is debited when the order is validated. Consequently, the credit card will be debited even if one or more items cannot be delivered. In such a case, and in the event of total unavailability of one or more products, the relevant amounts will be refunded. If all the references of an order are unavailable, the amount and shipping costs will be refunded in full. It is further specified that in case of temporary or permanent unavailability of one or more products, no compensation or damages are due by Juval Horlogerie Sàrl.
Art. 9: Transfer of risk Risk passes to the purchaser upon conclusion of the contract, in accordance with Art. 185 CO. Delivery is therefore made at the buyer’s risk.
Art. 10 : Guarantees Juval Horlogerie Sàrl only guarantees that the products delivered correspond to the products ordered in terms of quantity. All other warranties are expressly excluded by Juval Horlogerie Sàrl. If, upon receipt of the products, the buyer notes that the products delivered do not correspond to the quantities ordered, he must inform Juval Horlogerie Sàrl by email within 10 days of receipt of the order. Juval Horlogerie Sàrl will then send the buyer a return authorization. The buyer will have 5 working days from receipt of the authorization to return the non-conforming products. If the products are not returned within this period, the purchaser will be deemed to have waived the right to return the products. Juval Horlogerie Sàrl will replace returned products upon receipt. In case of impossibility or stock shortage, products that cannot be replaced will be reimbursed. Juval Horlogerie Sàrl accepts no liability for direct or indirect damage suffered by the purchaser and/or the purchaser’s customers/contractors in connection with the products delivered. All product information available on the website (in particular photos) may differ from the actual product and is therefore published without obligation. Juval Horlogerie Sàrl assumes no responsibility in the event that the products delivered do not comply with the legislation of the country of delivery, whether in terms of composition, ingredients, labelling or otherwise. It is the purchaser’s responsibility to ascertain whether the product ordered and the quantities allowed comply with the legislation of the country in which he/she is domiciled. No refund or compensation will be granted if the products ordered are seized by customs. Any related costs, taxes and fines will be borne exclusively by the purchaser.
Art. 11 : Content and data on the website Data, photos, information, prices, descriptions, trademarks, etc. (hereinafter referred to as “data”) appearing on the website are the exclusive property of Juval Horlogerie Sàrl. Users of the website are not authorized to use, reproduce, copy, download or modify said data for their own account or for the account of a third party.
Art. 12 : Data protection Juval Horlogerie Sàrl undertakes to treat the purchaser’s personal data in accordance with the provisions of the Federal Data Protection Act of June 19, 1992. Juval Horlogerie Sàrl will only pass on personal data to third parties insofar as this is necessary for the proper execution of the order.

Art. 14 : Severability clause Should any provision of these terms and conditions be declared invalid or unenforceable for any reason whatsoever, it shall, to the extent possible, be adapted rather than rescinded in order to best meet the intent of the parties. In any event, all other provisions of these terms and conditions shall remain valid and enforceable to the extent that they are compatible.
Art. 15 : Applicable law This agreement is governed exclusively by Swiss law.
Art. 16 : Jurisdiction The ordinary courts of the Canton of Neuchâtel have exclusive jurisdiction to hear any dispute arising from the interpretation or execution of the sales contract resulting from an order placed via the website.
Shipping conditions Shipping costs vary according to weight, quantity and buyer’s location.
In Switzerland, a flat-rate charge of CHF 13.00 applies to Priority+Signature items up to 2.00 kg. International rates vary from country to country. The rate is indicated as part of the order process. If the destination country is unknown to the system, the rate displayed will be CHF 9999. In this case, please contact Juval Horlogerie Sàrl.
